I am now unsure if I need to go through the process of obtaining H1B visa stamping in my passport in order to enter and work in the USA. Quote Link to comment
newacct Posted January 30 Report Share Posted January 30 No. Canadian citizens do not need a visa to enter the US in all nonimmigrant statuses except E, K, V, or S. See 9 FAM 201.1-3(B). You would simply travel to any US port of entry with your Canadian passport, and present the same evidence that other nationalities would present at a US consulate to get a visa (i.e. in the case of H1b, your H1b petition approval), to be admitted into H1b status. Also, H1b is a nonimmigrant status, and is completely separate from the employment-based immigration petition (I-140). Quote Link to comment
