My mom is in the US in tourist visa (first time visiting) and when she entered they gave only 3 months in the i94 validity but I want her to stay with me for the new year, so I have applied for 539 form 45 days prior to the end of 3 months asking to extend her stay…. I have not received a response yet from the USCIS. Can my mom stay after the i94 date as she has applied for 539 asking permission ? Will this affect her future entry in any way? newacct Posted November 24, 2023 Report Share Posted November 24, 2023 Yes, she can stay in the US for as long as the I-539 is pending. If the I-539 is approved or if she leaves the US while the I-539 is pending, it will not affect her visa. However, if her I-539 is denied and she is still in the US on the date of denial, her visa will be voided. Quote Link to comment
