Attorney_24 Posted November 20 Report Share Posted November 20 Determination on whether an H-1B maintained valid status during the unpaid leave period will be on a case-by-case basis. Various factors including reasons for the leave, supporting documentation, expectation of continuation employment after the leave period etc will be taken into consideration by the USCIS.
