spshah3013 Posted October 23, 2023 Report Share Posted October 23, 2023 Hello, My AP is under renewal at Texas Service center for the processing time is 18 month. I have approved H1B until 2026. I am looking to travel to India in Jan/Feb 2024. Will it be an issue, if I get my H1B stamped in India and use that re-enter US while AP Renewal is pending? Would that cause issue with my green card application? My PD is Feb 2013 so at present does not seem like I am getting green card anytime soon. I cannot wait for 18 months to travel to India. newacct Posted October 24, 2023 Report Share Posted October 24, 2023 Have you maintained H1b status until now (i.e. you last entered on an H1b visa and not on Advance Parole, you did not work outside of H1b, etc.)? If so, you can leave and return on an H1b visa and it would not abandon your I-485. Quote Link to comment
