Are we eligible to file H1b Cap exempt now?

Hi,

Below are the sequence of events on my wife’s H1b. Can she claim the left over h1b years now based on the first approved petition?

1. First Petition (10/01/2015 - 9/30/2016) - Stamped and stated working from 12/05/2015

2. Extension Approval (9/30/2016-9/30/2017)

3. Extension petition was revoked on 5/12/2017

4. Left the country on 8/30/2017 and will be coming back this year end.

Yes, your wife has a total of six years on her H1b.  Hopefully she will be able to find an employer who can also start her GC I-140 process.  Good Luck.
