Attorney_9 Posted October 23, 2023 Report Share Posted October 23, 2023 While you would need to disclose you violated your F-1 status by remaining in the U.S., you would not have been unlawfully present unless USCIS or an immigration made a status violation finding against. Having an immigration attorney review your history prior to applying for a visa and traveling would be helpful.
