H1BUser24 Posted October 8, 2023 Report Share Posted October 8, 2023 My son (21 years old student and unemployed) is filing for immigration for myself and my spouse (unemployed, homemaker) in the immediate relative (IR5) category. I have been employed in the US for 15 years and have earned 40 SSA credits. My spouse and I have been living in the same principal residence as my son and I am head of the household financially supporting my son and spouse. I am eligible for I-864W (having earned 40 credits) and also, I-864 (if I show evidence of my income from work) and my spouse is eligible for I-864W (having credited 40 points during the marriage) and I-864A (considering my household income). Here are my questions. 1. What form would be good to file for myself, I-864W or I-864? 2. What form would be good to file for my spouse, I-864W or I-864A Quote Link to comment
