vmehrotra Posted June 23, 2011 Report Share Posted June 23, 2011 Hi All, I have a question. I got my I-140 approved in EB2 category. My wife got I-140 approved in EB3 category. We filed I-485 for both of us based on her I-140. My I-485 is filed with status dependent. But I received A number on I-485 receipt same as on my I-140. Does this mean that my category has changed? Belle Posted June 26, 2011 Report Share Posted June 26, 2011 You can call and create a service request to be considered based on your own I-140. You will need the I-140 receipt number. Please be aware that your PD will most likely be based on your case, not on your wife's case. Link to comment

Belle Posted July 8, 2011 Report Share Posted July 8, 2011 Why do you need your PD? Your PD will depend on what petition you will choose your eligibility based on. You should first decide whether you want to go with your case or our spouse's case. Link to comment

vmehrotra Posted July 14, 2011 Author Report Share Posted July 14, 2011 Hi Belle, Sorry for asking you question. I checked my documents and found that I received RFE in 2009. USCIS asked me permanent employment letter. We replied that I am dependent and do not have to provide employment letter. This means that we have already choosen that I want to be on my wife's EB3. Thanks for looking into my question. Looks like that I need to wait for EB3 to be current and nothing I can do today to change my case to EB2. Link to comment
