SureshT Posted September 4 Report Share Posted September 4 Hi, My H1 and Spouse H4 extensions are filed in May 2023 and they are under review with USCIS. Also my spouse EAD is expiring on Sep 7th, However I have sent all the H4 EAD renewal documents to USCIS using H1 and H4 receipts notices. My spouse i94 expires on 17th September. Can you please clarify on below please: 1. My spouse can work after Sep7th?, being H1, H4 filed and H4 EAD Documents sent to USCIS (or If USICS accept the H4 EAD document and provide the receipt notice for EAD)? Please let me know. newacct Posted September 5 Report Share Posted September 5 Your spouse can work until Sep 17. They can work on a pending H4 EAD renewal with a valid H4 I-94 for 540 days. However, they cannot work after their H4 I-94 expires. Did your company apply for your H1b extension with premium processing? If your H1b is approved quickly, your spouse can leave and re-enter the US to get a new H4 I-94, and then be able to work on the pending EAD renewal. Quote Link to comment
