H1B amendment while H1 transfer is in progress

Hi,

Really appreciate your input to my current situation.

 

1) H1 transfer in progress to new employer which was filed July 24th.

2) I will need to move in Sept 2023 to different state ( new employer has already accounted for address change).

 

Questions.

 1) Can I request H1 location amendment with current employer  as H1 transfer might not complete within timeframe.

 2) Am I allowed to request H1B amendment with current employer while H1 transfer is in progress?

 3) If H1b Amendment with current employer gets approved after H1 transfer gets approved , will that be an issue?

 

New employer wont do premium processing for H1 transfer and I am not joining based on Receipt.

You say in point no. 2) that new employer has already accounted for address change.  Please see your LCA from new employer, if it has the address of the different state where you will move in, in Sept. 2023.

If yes, then no amendment is required as it has been taken care of during transfer itself.  Good Luck.

@Zodiac System Thank you for your response but I would not be joining new employer till I get approval and would be moving to new location before that. Please let me if I should request H1B location amendment from current employer.

If the move is short term i.e. 30 to 60 days, it does not need an amendment.  Hopefully by then you will get the approval from your transfer/new employer.  Good Luck.
