You will have to give Power of Attorney to your brother-in-law for taking decisions for the kid (minor on your behalf. Please consult an attorney. Quote Link to comment
JoeF Posted June 20, 2023 Report Share Posted June 20, 2023 While it usually is ok for people on H4 to stay in the US if the person on H1 goes on a short vacation abroad (even that is technically wrong), it certainly is not possible to a dependent to stay in the US on H4 if the primary person on H1 moves abroad While it is possible to change to a B2, I believe that doesn't allow attending school.
