JJJ146 Posted June 3, 2023 Report Posted June 3, 2023 Trying to keep my long winded story short. 2017 Feb - Moved to US from India on a L1A 2019 Oct - L1 A extension approved 2020 Jun - Company applies for H1B Lottery 2021 Jan - H1B approved until ( Apr 2023) based on time i was on L1A 2021 May- Company applies for EB1C 2021 Nov - 2nd L1A extension rejected 2022 Apr - Moved to H1B 2022 May - L1A RFE ( my org decided not to pursue further ) 2022 Sep - Applied for EB2 - Initiated LC 2023 Mar - Recapture Time Extension tile Sep 23 applied 2023 May - i129 approved. Trying to see what are my options to stay in this country post Sep '23. My company lawyer is one of the worst i have ever worked with. I brought a home in 2021 Sep ( when things looked good ) and now i need to figure out what to do with it. Daughter is 5.5 years old and she was born here. Any recommendations will be highly appreciated. Quote
Zodiac System Posted June 5, 2023 Report Posted June 5, 2023 Looks like your I-140 has been initiated in Sept. 2022 - EB2 category. If your PERM is approved by Sept. 23 & you have a pending I-140 (365 days after it was applied in Sept. 2022), your employer may be able to apply for a one year extension on H1b, while your I-140 approval is pending. However these timings are very neck to neck. Alternatively you can go to India for a few weeks and save some time on current H1b and return back, once your PERM is approved. Good Luck. Quote
