Sowmya O
Hi, I got my H1B approved in the 2015 and then I started working on H1B from November, 2015 to June 2016. Got my visa stamped in April 2016 and after that did not return to the US. It expired in October 2018. Seems like in August 2017 my employer sent a revocation notice. Now, I would like to transfer my H1B to another employer. Could you please let me know if that can be cap exempt or do we need to file for a new H1? Quote Link to comment
pontevecchio
Any potential employer needs to file a new non-cap H1 and get it approved . You are eligible for the remainder option of 5.5 years in H1 status. Quote Link to comment
Attorney_15
Generally, if one has been issued a visa stamp based on an approved H1B Cap petition, the person should be treated as Cap Exempt by a subsequent employer. Quote Link to comment
