Return to US after spending 5 years in India

Hello Experts,

I moved to India in 2019 when I joined a new employer when I had approved I-140 with a priority date of Dec-2012 in the EB2 category filled in my previous job. Now I want to return to US and was wondering if all I need is a transfer of H1B to my new employer or I will have to fill a new H1B subject to the annual cap.

You have an I-140.  I think all you need to do is file for an H1b transfer.  Good Luck.
