jasmina Posted April 25, 2011 Report Share Posted April 25, 2011 Hello All, My friend was on the H1B visa and recently got a 2 week termination notice from her employer. As an effect of that her H1B is expiaring on 5/5/11. Her husband works with different company on H1B visa and his employer planning to file an H4 for my friend.But till now her husband's employer not yet filed for H4. They will do it mostly by 4/29/11. Now she is under tension since she is not sure from when can she go on that H4 which will start on 4/29/11. Can she stay in this country even if by 5/6/11 she didn't hear anything from USICS about her new H4 status? Link to comment
pontevecchio Posted April 26, 2011 Report Share Posted April 26, 2011 Ask her to file the I-129 form for COS from H1 to H4 today with proof of being in H1 status and as long as she gets the receipt before her H1 job ends she is legal to stay. Why in tarnation is she waiting? Link to comment
