genericask Posted May 6 Author Report Share Posted May 6 Will the new employer(company-B) able to use the pending perm( of company-A) if it is pending more than 365 days ? For getting 1 years of H1b extension. If not, then I-140 process may take 1.5 to 2 years(PWD+Advertisement+PERM) which cannot done within 5month even if I find the new employer. Quote Link to comment

If I find the employer who will start GC, I-140. Is it mandatory to transfer H1b before I change status to F1 ? Or it is not necessary. If So, will it impact my H1b continuation with new employer(when filing i-140) at the time of F1 to H1b status change if my previous employer revoke/withdraws it ? as I will be no more working with previous employer.
