Vik0811 Posted April 17, 2023 Report Posted April 17, 2023 Hello, I am currently in India and my H1B visa was recently approved. My passport was stamped a week ago and I have initiated dependent visa filing process for my wife and daughter through my employer. However, the employer is saying that for dependent process, the primary applicant must be in US for fixing the visa appointment dates for dependents. This is because they need to enter I-94 details while fixing the appointment. I-94 number will be generated only when the primary applicant enters US. Is it correct? Cannot I travel back to US with family after their visa is approved? Do I have to travel first and only then dependents visa can be filed? Kindly guide. Thanks Quote
pontevecchio Posted April 17, 2023 Report Posted April 17, 2023 That is not true. Get an advisory opinion from the firm of Murthy in Chennai and then forward it to your employer, should you feel the need to. Quote
