While I was in USA, I was working for X company but another consulting firm Y wanted to do my H1B transfer and PERM initiation. Due my visa issues with X company, I have to move out of US. after moving out from USA My H1B visa and PERM got approved with Y. Due to COVID I could not go for stamping. My Y company told that if we do not file I140, PERM will be invalid within 6 months so they filed I140, after few months I140 approved. So basically, I never worked with the Y but they has my I140. My question is, even though I did not work for them, If I get my I140 copy, should go and transfer my H1B with I140. Of course I have pay much to get my I140 copy. Please suggest. Attorney_15 Posted May 15 Report Share Posted May 15 Generally, when an I-140 petition is approved and has remained approved for at least 180 days (without withdrawal), the I-140 petition remains valid continuously. However, once the priority date becomes and remains current for one continuous year the beneficiary will generally lose eligibility to extend their H1B status. Quote Link to comment
