h1bgcard
Let's say if I am on level 2 wages and my PERM was filed for level 3 wages for GC application. Post i140 approval if I apply for h1b extension on basis of PERM and i140 application, what should be the LCA wages? Level2 or Level3? Quote Link to comment
Zodiac System
Your H1b will be applied by your employer (not you). Your employer can choose to apply level II or level III wages. Quote Link to comment
h1bgcard
I understand that H1B will be applied by employer. But is my employer need to file level 3 as the wage is higher and PERM was approved with that. Since the extension is based on PERM approval don't they have to use level 3 wages? whiskeyjack
From my understanding h1b and gc are separated and processed by different teams. Salaries on each don’t have to be strongly correlated, though they better do Quote Link to comment
