svallabh Posted February 28, 2023 Report Share Posted February 28, 2023 I have approved I140 from Employer A, Priority Date Jul'2015 and was approved in the year 2016. Employer A has applied to Withdraw I140 in Feb'2018 and the current status as on today of I140 petition is 'Correspondence Received and USCIS is Reviewing it'. Can employer A use I140 (same employer who filed my I140) funder CAB exempt and reapply H1B? I am currently in India. Quote Link to comment
Zodiac System Posted March 7, 2023 Report Share Posted March 7, 2023 To the best of my knowledge, I-140 cannot be withdrawan by your employer after six months of approval. Since your I-140 was approved in year 2016, his withdrawal notice sent after two years in 2018 should not have effect. Wonder why he would do that. Quote Link to comment
