Bharath Reddy Posted February 10, 2023 Report Share Posted February 10, 2023 Background: I am in L1A status and have completed 5 years of stay and entered into 6th year (first got L1 in July 2018). My firm applied PERM and I should receive my I140 by October 2023. My firm has been trying for my H1B from past couple of years and no luck. Questions: 1. If my H1B gets picked up this year (2023), will I get 6 years validity or just 1 year considering I already spent 5 years on L1A? 2. If I don't get my H1B this year, I will be into my 7th year by the time next H1B season comes up. If my H1B gets picked up next year, how many years will I get? (By that time I would have spent 6 years on L1 visa) 3. What are my options given my situation to continue to work in US. Quote Link to comment
pontevecchio Posted February 14, 2023 Report Share Posted February 14, 2023 Total time LIA plus H1 cannot exceed 7 years. You could leave and return on L1 A status after a year back home or return on the H1 after a year back home. Quote Link to comment

Response: 1 Year if u have only PERM approved, If u have approved I-140 then u could possibly get max up to 3 years2. If I don't get my H1B this year, I will be into my 7th year by the time next H1B season comes up. If my H1B gets picked up next year, how many years will I get? (By that time I would have spent 6 years on L1 visa) Response: Ideally u will not be eligible to apply, U should stay out of the US for 1 year then apply3.
