My last approved petition was from 2014-2017, but as mentioned I was in my home country. During my stay in home country, my H1B extension petition from home country was denied during 2018 for specialty occupation. So summary is I was on stamped H1B status back in 2014 and last have a denied petition in 2018. Currently I am on L1B status in USA. 2014 - Worked in USA on H1B 2014 - 2017 - Valid petition but worked in home country 2018 - Petition denied 2022 - On L1B in USA Can my H1B petition be used as cap-exempt given that my H1B status is not maintained within last 6 years from now (2022).
