I-94 Issue

Hello,

I came to US by Sep 2007 on H1 VISA (petition valid till April 2009) through Company A and stayed here till Aug 2008. Then, I did my H1-transfer to Company B and received my approval (petition) by Aug 2008 (valid till July 2011).

Then, I went back to India and I came back to US on Company A visa and worked till Mar 2009 and started working with Company B from then till now.

How can I proceed further?

1.) Can I get my H1-extension with a valid I-94 ?

Or

2) Do I have to go 2 India to get my stamping and then come back and apply for extension?

Or

3.) Based on the forums, Do I need to go to a CBP office ? If so, which is better ?

Or

4.) Apply a nunc pro trunc with support of attorney ?

Please advise, as my latest I-797 is valid ONLY till July 2011.

On what basis? You had an I94 reflecting A. Talk to a LAwyer ASAP.

I came through Company A with company A visa and petition and worked for company A for a while, then I quit company A to join Company B.

Did you have an H1 approval with I94 dfor B?

Yes, I have a valid I-797 petition (NOT H1 visa) till July '11 for B.
