H4 to H1 back to H4 now to H1

Hello Gurus,

Please advice on this situation, thanking you all in advance.

I entered on H4.

I got job in US and a new H1.

This was cap exempt.

job loss in July 11.

left country and reentered on H4 immediately.

currently on H4 in the country.

New job offer from cap limit employer.

they will file petition.

Question is.

can i work before october with reference to my earlier 797 with ' AC21 law'.
