My case : I was in H1B visa from 2006 to 2009, 2009 to 2012 and 2012 to 2015 with employer 1. I got my I140 approved with employer 1 with priority date on 2011. I switched employer on 2015 and got H1 extension till 2018, During 2017 time frame, I moved to H4 and then during 2020 I got divorce and I came to India. Currently I am in India and I have an employer willing to sponsor but he wants to know whether I will be eligible for cap-exempt H1B sponsorship. Since I have a I140 approved and also some H1B time I didn't use between 2015 to 2018 timeframe (after first 6 years) will I be eligible for cap-exempt sponsorship? Quote Link to comment
Zodiac System Posted May 26, 2022 Report Share Posted May 26, 2022 (edited) Your employer is associated with an attorney. His attorney should be advising him on this, instead of him asking you.
