H1b max out and no perm filed

Hi, my H1b visa is going to maxout on 06/09/2022 and my PERM was not initiated by my employer. However, they are moving me to Canada in May.
I have the following questions:

1. Can I apply for PERM from Canada while working for the same employer and US based client?

2. Should I save some time on the current H1b visa as in not stay in the country till the maxout date or will I have to get a new H1? Will I be lottery exempt in that case?

Any help with these queries is highly appreciated.
