deepthisatish Posted March 15, 2022 Report Share Posted March 15, 2022 Hi Everyone, I have a question regarding H1B.I worked on H1b in 2012 for 8 months and in 2013 for 4 months.So overall i have worked for 1 year on H1B in USA.After that i didnt utilize H1B and it got expired.Now iam coming to USA on H4 in 2022.So can i invoke my previous H1B which got expired with the company which i resigned long back? pontevecchio Posted March 17, 2022 Report Share Posted March 17, 2022 You are entitled to claim the "remainder" option of 5 years in total with no period of H1 status being more than 3 years at a time. The process is the same. You need to find a H1 sponsor to file a non-cap H1 Petition for you. Quote Link to comment

I mean both normal and premium costs? Nothing for you. The employer has to pay for the H1. Why do you even think you have to pay anything? The only thing you are allowed to pay would be the cost for premium processing. A good employer would pay that as well, though, if they really want you quickly. Quote Link to comment
