Arcku Posted September 27, 2021 Report Share Posted September 27, 2021 I am a US citizen and have filed for green card consular processing for my parents in India. Their DS-260 was approved by NVC back in April 2020. Their case is with the Mumbai Consulate for interview, but due to the COVID-19 pandemic an interview date has not be provided. My parents have a 10-yr US tourist visa that expires in Feb 2023. My question is - can my parents visit us on the tourist visa and apply for an adjustment of status here or would you advise them to wait for the consular processing interview in India? Would filing an adjustment of status in the US reset their green card clock? Any other issues you see with this situation? Quote Link to comment
pontevecchio Posted September 27, 2021 Report Share Posted September 27, 2021 I would ask them to wait for the consular Appointment and come over with an Immigration Visa. I suspect that would still be faster and avoid the potential dangers of using a tourist visa under the circumstances. Quote Link to comment
