h1bh1b Posted September 2, 2021 Report Share Posted September 2, 2021 Hi all, My i-797 was valid from october 2014 to August 2017 but my H1B was revoked in March 2016 due to employer fraud. All H1Bs under the employer were revoked. If an employer is willing to sponsor me H1B now, do I have to go through the lottery system again?. Please suggest what options I have to get H1B visa. JoeF Posted September 3, 2021 Report Share Posted September 3, 2021 Since you haven't used the full 6 years you are cap-exempt. H1 revocation happens when you leave the H1 job. The employer has to report that to USCIS, and they revoke the H1 petition. It has no effect on you or your ability to use the remaining time. Quote Link to comment
