rahul_nyc Posted July 12, 2011 Report Share Posted July 12, 2011 I have an approved I-140 and a pending I-485 in EB3. I have now filed a new GC petition in EB2. Once the priority date of the EB3 case is ported to the new EB2's I-140 application and the application gets approved, do I have to file I-485 again or will I get the GC based on the pending I-485 of EB3? veni001 Posted July 12, 2011 Report Share Posted July 12, 2011 One can only have one AOS(i485) application at any one time, upon approval of EB2-i140 your employer can send interfile request to USCIS, check with your attorney. Link to comment
