Ajay ajay Posted May 27, 2021 Report Share Posted May 27, 2021 My parents are in the US and their B2 Visa expires in Oct 21 and due to current situation in India, we are thinking to extend their stay. the current I94 is given for 6 months and expires in Aug 21, Is this possible to apply for i94 extension beyond Visa expiry? Will there be any problem when leaving the country or when they renew their visa in India? Is it even possible to renew the visa also from us? Quote Link to comment

sgrcres Posted May 28, 2021 Report Share Posted May 28, 2021 You should apply for extension well before the I94 expires. If US gives extension before I94 expires, then it will be the ideal situation. Your parents can stay in US while the application is pending, but for some reason their application is denied after the I94 expires, then they may have trouble entering US in the future or may have trouble in getting a new visitor visa in the future. There is no issue on leaving the US on expired I94 though as US does not immigration while leaving US. On the question of visitor visa expiry, one cannot get visa renewal in US. Also B2 visa expiry has nothing to do with I94 expiry, one can stay in US even if the B2 entry visa expires after entering the US as long as the I94 is valid. Quote Link to comment
