Current I797A is valid till Dec 2022, Visa Stamp on Passport is valid till Dec2021. Planning to quit the job and go back to my home country for 6 months or so. If I can find an H1b job after 6 months, will the employer be able to apply for cap exempt H1b or do I have to go through lottery process again? Also if the employer is able to apply for H1b, do I need to go for stamping again or can I use the existing valid stamp and enter US? Thanks Quote Link to comment
Zodiac System Posted February 22, 2021 Report Share Posted February 22, 2021 After 6 months, your new employer B will be able to apply for a cap exempt H1b, based on your current H1b approval and I140. The stamp does give the name of the employer and your approval number on it, but it is not employer specific. You should be able to use the valid visa stamp and enter US, along with valid approval from new employer B. Quote Link to comment
