Bala G Posted February 15, 2021 Report Share Posted February 15, 2021 Hello, Myself travelled to USA on Jan 2020 (H1B Valid till Aug 2020) In Mar 2020 moved to Employer B, I got extension till Dec 2023 & have new I-797A In Jun 2020 my family moved to USA with Employer A H4 Visa and produced new I-797 (Valid till Dec 2023) Now I realized that my family' I-94 has admit date until Aug 2020 as per Employer A Visa and NOT as per Employer B I797A. So, Does family stay Illegal now? What is the impact and what are the options I do have? Please advice! Thanks in advance. Quote Link to comment

pontevecchio Posted February 16, 2021 Report Share Posted February 16, 2021 The H4 visa is NOT employer-dependent. They should have shown your latest H1 approval on entry. You should run this by a Lawyer ASAP. Your family is out of status and in unlawful status. Keep the 6 month limit in mind and get a lawyer involved. Quote Link to comment
