harry85
Hi, I'm currently working on L1-b visa and got laid off last month. My last working day with my current employer ends in the next 7 days. Meanwhile, the H1b premium for RFE response is filed from the employer today and may get the result in the next 15 days. My question is, If I get H1-b approval after my exit date with my current employer, can I stay in the US and search for a new job based on H1-b or will my H1b become invalid as I will not be working with my current employer when my H1-b is approved? Thanks in advance for any help I can get! Quote Link to comment
Zodiac System
You have 60 days time after getting laid off to find another job. Your Approved H1b (expected very soon), will help you to get a transfer to another employer. Your current employer will withdraw your current H1b approval (once it is approved, as required by law). When does your I-94 expire? Edited January 8, 2021 by Zodiac System Quote Link to comment
