H1B WILL EXPIRY April 2021 AND IAM NOT IN USA

Hi all,

 

I have 140 approved with my company and my current H1 B expiry in April 2021.

I came to India on sep 2020 due to family emergency and I was thinking of going back to USA before my visa expires but what to be with my family till it possible.

could you guys please help with the question . Within how days I can travel back to USA without any Immigration issues  before my visa expires ??

Better give yourself 1 to 1.5 months..

Feb would be your best bet to travel, from there you will 60 days to apply for your 797 extension, if your employer is ready to extend while you are with your family then you might even consider traveling after getting extension and schedule your visit to consulate for stamping.

You should plan to head back by Feb since there is a time limit (6 months in most cases) on an h1b working from outside the country. This happened to one of our team members and the lawyer asked them to come back into the country before the 6 month time limit.
