GgSat Posted September 25, 2020 Report Posted September 25, 2020 (edited) Hi we have filed our Green Card in EB3 category with previous employer in 2010 Aug and my pirority date is current AUG 2010. But my current employer Not yet filed/initiated my perm. Can someone help me on this. Can i directly apply for i140 and I485 concurrently without perm with current employer? Or is it possible to file I485 outside without any employer? Or i have to file I485 directly with previous employer without working with them? Please share your thoughts on this Edited September 25, 2020 by GgSat Quote
pontevecchio Posted September 27, 2020 Report Posted September 27, 2020 If the GC sponsor wants you to work for them, that would be the ideal situation for you. Do they want you? Quote
jump00 Posted September 27, 2020 Report Posted September 27, 2020 I am in same boat and seeking guidance. I read and posted "I-485 AND JOB PORTABILITY UNDER INA SECTION 204(J)". You may check my question related to your. Hope some expert can guide us. Quote
JoeF Posted September 27, 2020 Report Posted September 27, 2020 (edited) Your current employer would have to have an approved PERM before he can file an I-140. If you file an I-485 for the old employer you will have to start working for them when the I-485 is approved. It would be fraud otherwise. Edited September 27, 2020 by JoeF Quote
JoeF Posted September 29, 2020 Report Posted September 29, 2020 I-485 portability requires that the I-485 has been pending for 180 days. Quote
