Yogeshwar V Posted September 16, 2020 Report Posted September 16, 2020 Hello, My I140 got approved From employer A, and i moved to Employer B exactly after 182 days after my I140 approval date. 1) Is my i140 still Valid? 2) If it is Valid Can i use it for my H1B Extensions ? 3) Can i file for H4 EAD using that I140 or Do i need to start over the I140 process again? What is my next step to keep the I140 active, Thanks. Quote
pontevecchio Posted September 18, 2020 Report Posted September 18, 2020 Your I-140 should be "valid" from the point of view of H1 extensions till the PD of that I-140 is current. Your spouse can file for the EAD if the I-140 is not revoked and it would be unusual for a company to revoke an I-140. Quote

But new employer not ready to start the green card process. So , i know the best option is change job and get green card process start asap. But your response scared me . What happens if there is a delay in getting the perm and new I-140 process and PD becomes active. What options I have? Your answer helps lot. TIA Quote
