YogendraK Posted September 10, 2020 Report Share Posted September 10, 2020 Hello, I have an approved I-140 (approved in 2015). I am on H1 and got terminated on 07/31/2020. I am planning to go on H4 as my spouse has H1. Few Questions 1) If I go on H4 and keep looking for H1 petitioner, what is my status? What do I say when prospective employer asks me? 2) how easy or hard is it, to convert from H4 to H1? 3) If I convert from H4 to H1 and file for my green card, does my priority date remain valid ? or do I lose my date because I moved to H4? You are basically looking for H1 sponsorship and your employers petition will be not subject to the cap. 2. Getting an H1 sponsor is the problem. 3. Your employer files for your GC.
