pontevecchio
Only your company can file. So you need to touch base with your supervisor to see what the company can do. Quote Link to comment
vivek1234
Thanks for the info but my concern is can My company file i140 under EB2 to EB1C porting while I am in India.. Quote Link to comment
pontevecchio
The company can file your EB1C petition. The fact that you have an EB2 approved is irrelevant. Both are separate applications and EB2 wait is much more than EB1. Nothing to port. Two separate I-140 applications. Quote Link to comment
vivek1234
Thanks, Do I need to have a valid H1B/L1A petition approved(I797) before applying for EB1C i140 with USCIS while I am in India. Thanks Edited August 13, 2020 by vivek1234 Quote Link to comment
pontevecchio
No. I know all semantics, but the employer has to file should you qualify. Edited August 14, 2020 by pontevecchio Quote Link to comment
