immigrant27 Posted July 30, 2020 Report Posted July 30, 2020 Here's my situation. I am on H1B visa with an approved I140. Recently I got laid off from Employer A, with 60 days grace period during covid. To buy myself more time, I filed my H1B transfer application through Employer B (consultancy), which is still in regular processing, and I am waiting for my Receipt. The check has been cashed, and I am hoping to get the receipt anytime in next 1-2 weeks. I recently got an offer from a very renown Employer C, and they are beginning my H1B transfer process in premium processing. Current issue is I don't have any paystub from Employer B and still waiting on the receipt of their transfer application. Is there going to be any issues if Employer C files my transfer petition? Can I submit Employer A paystubs to Employer C in order to begin with their transfer process? What other issues I could face with such situation? Suggestions and advices please! Quote
gopalakrishnach Posted July 30, 2020 Report Posted July 30, 2020 Is Employer C is submitting the application after 60 days. If yes C can submit new petition with USCIS and I feel it depends on B decision. If no C can submit new petition with USCIS with A paystubs. Let experts weigh-in. Quote
