I have a Valid H1B visa till Aug 25 2020 from Employer A, i have got a new project on w2 from Employer B, but they are asking me to travel on my old I797 A of Employer A. Saying that there will not be any issue at POE. Once you are in US then Employer B will file a H1B Transfer. Can this be Done? Please suggest? Quote Link to comment

I do not know how POE things going on during COVID times. Do not be hasty and once you denied entry at POE it will be in your record for ever. Quote Link to comment

debut2005 Posted September 15, 2020 Author Report Share Posted September 15, 2020 I did not travel , it is not worth it, as it is illegal and, it may lead to upto 10 years ban. You must have a approved I-797 and then travel from the new employer. If you are in India and someone is asking you to travel and will file H1B transfer on the first day. This may be problematic. No legitimate employer would ask you to commit immigration fraud. B would have to file a transfer, and once approved you can travel with the existing visa and a copy of the new approval notice.
