I filed my H1B extension on normal processing in March month and my 1-94 also expired on 240 days Grace period. I'm planning to convert that petition into Premium, I wanted to check the worst-case scenario as if my H1B extension is rejected. Can I file another petition with a new employer after the H1B is rejected? [I heard, because of covid 19 we can say up to 2 months after the H1B is rejected and I can file a petition in that 2 months] Your suggestions/inputs are greatly appreciated. Thanks in Advance. Quote

User099 Posted June 26, 2020 Report Posted June 26, 2020 2 month grace period is only if you loose you job and have a valid I94. In your case, you don't have a valid I94 and you will have to leave in 30 days after receiving the rejection letter. Quote
