H1B extension & Rejection Case Scenario

Hi, Greeting for the Day !

 

I filed my H1B extension on normal processing in March month and my 1-94 also expired on 240 days Grace period.

I'm planning to convert that petition into Premium, I wanted to check the worst-case scenario as if my H1B extension is rejected.

Can I file another petition with a new employer after the H1B is rejected? [I heard, because of covid 19 we can say up to 2 months after the H1B is rejected and I can file a petition in that 2 months]

Since your I94 expired I do not know new H1B can be filed after current H1B extension is denied. Your case is tricky better consult immigration lawyer.

2 month grace period is only if you loose you job and have a valid I94. In your case, you don't have a valid I94 and you will have to leave in 30 days after receiving the rejection letter.

For safe side may be you can file new amendment(Add some duties and make it as a senior role) and wait until get the result. If the old one is approved, you can with draw your new amendment.
