However my employer is not submitting the applications due to some organization decisions made. Can any other consultant firm file my application or it has to be only my employer? JoeF Posted June 22, 2020 Report Posted June 22, 2020 Only the original employer can file the H1 petition. If the employer doesn't want to do that then you can't get an H1. An employer can file an H1 for you in next year's lottery. Quote
