gopalakrishnach Posted June 18, 2020 Report Posted June 18, 2020 (edited) Before 60 days or end of I94 which ever comes first you need to have H1B petition. If not you need to leave ASAP after 60 days. You can have B2 petition for 60 days rule and after it is approved you can have H1B COS petition. But B2 to H1B is complicated I feel. I maybe wrong. User099 Posted June 18, 2020 Report Posted June 18, 2020 You should file a COS to an other visa status if you want to be in the country after the 60 day grace period. New employer can file for a new H1, but it might be consular processing. You should check with an attorney to make sure whats the best case for you. Quote
