Sachin Kumr Posted June 10, 2020 Report Share Posted June 10, 2020 I already consumed 4 years on current H1B and my I797 validity is also going to expire soon(after completely consuming 4 years on H1B). I will be moving to India after that and will be there for 1.5 years or so. My question is, after that if i decide to travel to USA for work, can I come here on same H1B or I need to go through lottery process again. In Case if I can come on same H1B, then in that case, what document I will need to file for H1B extension as my current I797 will be completed by then. Quote Link to comment

gopalakrishnach Posted June 11, 2020 Report Share Posted June 11, 2020 If you do not want to reset clock just apply H1B for remaining 2 years anytime during the year. But if you want to reset clock and get fresh 6 years you need to go throught lottery. Quote Link to comment
