kiku83
Hi, Recently I got laid off from my startup (on H1B visa with I-140 approved) and 2 months grace period expired on April 1st. On March 26th, I applied for H4 COS and now my extension is pending. I got offer from another startup this week, Can I start working after getting the H1B receipt or should wait until H1B transfer processing is complete? Are there any options to start working immediately? If not, can I start working as an unpaid intern and is it legal? Comments are appreciated. Thanks Edited May 7, 2020 by kiku83 Missed to include I-140 info Quote Link to comment
gopalakrishnach
Better start working after approval but in your case it seems you do not have H4 EAD also now. So I feel you can take risk and join on H1B receipt to start work and get paid. If you can best is H1B approval. If not, can I start working as an unpaid intern and is it legal? - Illegal I guess.
