My I-94 expired on 02/02/2020, right know I am still working under the 240 day rule. Employer filed H1B extension back in October 2019, my 6 year max out is 10/01/2020. I received RFE on 01/23/2020 and submitted response 04/16/2020.Since my I-94 has already expired, but I am not maxed out, am I eligible for the 60 day grace period? in case my H1B extension is denied.Thank you. User099 Posted April 20, 2020 Report Share Posted April 20, 2020 Since you I94 is expired, you don't get any grace period. If the H1 is denied, you will have to leave the country in 2-3 weeks. If your H1 is pending till 10/1/2020, you will have to leave by your max out date. Quote Link to comment
JoeF Posted April 21, 2020 Report Share Posted April 21, 2020 The grace period in case of job loss is 60 days or until the I-94 expires, whichever is shorter. Since your I-94 already expired there wouldn't be any grace period. Quote Link to comment
