dv123 Posted March 5, 2020 Report Share Posted March 5, 2020 Hi, I have my H1B visa stamping in my passport until August 2022. But my Passport expiry is on 05/31/2020. Because of this when I travelled outside US in Sept 2019, I got I-94 only until 05/31/2020. Now I got new passport. My company is suggesting to apply I-129 extension in a regular processing instead of travelling outside US now. I have a scheduled visit to go to India in July 2020. My question is... If I don't get approval by my travel date ( Just 1st week) , can I travel on Receipt and comeback to US as I have valid visa stamping until August 2022. Could you please suggest. User099 Posted March 6, 2020 Report Share Posted March 6, 2020 When is your current H1 petition expiring? If its 2022, how is your employer applying for an extension so soon? Don't travel on receipt notice, try to do premium processing and travel only if you have an approval notice. Quote Link to comment
adshah84 Posted March 13, 2020 Report Share Posted March 13, 2020 Oh you do not need to do anything. Just go to India and come back with old Visa and new Passport. At the entry you will get updated I94 with validity till August 2022. You already have Visa. YOU DO NOT NEED TO FILE ANY EXTENSION. Quote Link to comment
