Company B is going to file H1 transfer in premium. my questions are, 1. If Company B H1 petition is getting approved and I joined B. Now, Company A H1 extension gets RFE(I’m 100 percent sure that there will be RFE). Not sure if company A responds to rfe. If they don’t respond, what will happen and if they respond, based on approval or rejection, what will happen. 2. In worst case, Company A H1 is getting approved after I joined Company B, what will happen in this case? B’s outcome is depending on A’s outcome? In this case, B is called bridge petition? To avoid this dependency, is option 3 correct? 3. irrespective of Company A H1 decision(rfe or approval), if I travel to India after company B petition is approved and getting my visa stamped with new i94, there should not be a problem about A’s outcome? thanks Quote Link to comment
User099 Posted March 2, 2020 Report Share Posted March 2, 2020 Let Company B apply in Consular processing and when apporved go for stamping and come back. This will be the best option than having a dependecy on A's petition by doing a bridge. Even if A's petition gets approved after you move to B's its not an issue. Quote Link to comment
