Tyagi Posted October 2, 2019 Report Share Posted October 2, 2019 Hi, I have completed 6 Years on H1B Visa in the month of May-2019 and according to rule I can apply new H1B after 1 year completion of my stay outside USA. My question is when can I apply for H1B Visa, Can I apply on April-2020 since if i get Visa then i can work from October-2020 which is 1 yr gap ? Quote Link to comment

JoeF Posted October 2, 2019 Report Share Posted October 2, 2019 No. An employer can FILE a new H1 for you after you've been outside the US for at least a year. So, in your case an employer could file in May 2020. If the quota is full by then the earliest date to file would be April 1, 2021. Quote Link to comment
